ALTERNATIVE DISPUTE RESOLUTION:

In recent years, alternative dispute resolution ("ADR") processes have revolutionized conflict management in the workplace, at the courthouse, within the family nest and even over the backyard fence.

Simply put ADR is the alternative to prolonged, expensive and emotionally draining litigation.  While no one today doubts that litigation is a marked improvement over dueling at dawn prevalent in the eighteenth and nineteenth centuries, ADR is the twenty-first century's increasingly preferred response to disputes and conflict.

The spectrum of conflict resolution responses includes (1) in-house preventative measures through staff training, conflict identification, internal problem-solving frameworks, facilitation, advisory fact-finding or outcome prediction, to (2) dispute resolution through mediation and arbitration and (3) finally to rights-based decision-making by a tribunal or court.
